Super Mario 64 HD, Progetto di un Fan che ha - per ora - ricreato il primo livello del gioco in HD è stato preso di mira dagli Avvocati della Nintendo. Nintendo avrebbe fatto chiudere il progetto perché Roystan Ross (Progammatore e Fan di Mario) avrebbe utilizzato materiale proveniente da altri giochi di Super Mario.
Ross ammette di aver utilizzato i modelli di Mario, i Goomba e delle Stelle (presi da Super Mario Galaxies), oltre numerosi file audio presi da svariati giochi
